The U.S. Supreme Court has ruled that tariffs imposed under IEEPA were unlawful. In response, the U.S. administration has replaced those tariffs with a new global duty under Section 122 of the Trade Act of 1974.
What’s changed?
- IEEPA tariffs have been formally terminated.
- U.S. Customs and Border Protection (CBP) has confirmed IEEPA duties will no longer apply to goods entered into the U.S. from 12:00 a.m. Eastern Time on 24 February 2026.
- A new global import duty has been introduced under Section 122 of the Trade Act of 1974.
- This new duty is currently set at 10%, effective from 24 February 2026.
- An increase to 15% has been announced, but final confirmation and implementation details from CBP are still pending.
What this means for shipments
Shipments from the United Kingdom
Goods manufactured in the UK will continue to be subject to a 10% additional duty (for now).
Shipments from other countries
Many products from other countries may see a lower additional duty rate than under the previous IEEPA tariffs.
What's not changing?
The following duties and rules remain in place:
- Standard U.S. import duty rates (MFN rates)
- Section 232 tariffs (for example, certain steel and aluminium products)
- Section 301 tariffs (primarily affecting certain China-origin goods)
- The current suspension of duty-free treatment for low-value shipments (de minimis)
Frequently asked questions
Will refunds be issued for IEEPA duties already paid?
At this time, there is no guidance from U.S. Customs regarding refunds. The Supreme Court decision did not address this, and no refund process has been announced.
Are IEEPA duties still being collected?
IEEPA tariffs will continue to apply until 24 February 2026. After that date, they will no longer be in effect.
Are other U.S. trade tariffs affected?
No. Section 232 and Section 301 tariffs remain fully in place.
What to expect
- Updated duty calculations for U.S.bound shipments from 24 February 2026.
- Our systems will automatically reflect the new rates for Delivered-Duty-Paid (DDP) calculations once final CBP implementation guidance is issued.
- UK-origin goods will remain at 10% additional duty for now.
- Some shipments from other origins may benefit from lower additional duties.
- There may be a short period of adjustment while final implementation details are confirmed.
